Welcome to BenGMusic! These Terms of Use (“Terms”) govern your access to and use of our music streaming service through the BenGMusic Android app and our website www.bengmusic.com (“Service”). By using our Service, you agree to these Terms.

1. Overview of Service
BenGMusic offers users the ability to stream music from our curated collection of playlists and tracks. Users can create their own playlists and save favorite songs from our catalog.

2. Account Registration & Eligibility
To use BenGMusic, you must register an account. All users receive a 30-day free trial. Continued access after the trial period requires a paid annual subscription. Each account may connect up to three (3) devices. Sharing login credentials with more than three devices is prohibited and may result in termination without refund.

You must be at least 13 years old to use this Service.

3. Subscriptions and Payments
After the 30-day trial, continued use requires an annual subscription for $50 USD. We accept the following payment methods:

  • PayPal

  • Credit/Debit Cards

  • CashApp

  • Venmo

  • Zelle

All payments are final. No refunds will be provided for any reason, including early cancellation, unused time, or technical issues.

4. Permitted Use & Restrictions
You may use BenGMusic solely for personal, non-commercial streaming. You are not allowed to:

  • Share your login beyond 3 devices

  • Attempt to bypass security or licensing mechanisms

  • Reverse-engineer, distribute, or copy content from the app

  • Use the service for any unlawful purposes

Users cannot upload, comment, or post content. The platform is strictly for streaming and playlist creation from our licensed collection.

5. Account Termination
We may suspend or permanently terminate your account without notice if you:

  • Share access with more than 3 devices

  • Attempt unauthorized access or violate these Terms

Terminated accounts will not be refunded.

6. Service Availability
We aim to keep BenGMusic running smoothly but do not guarantee uninterrupted access. We are not liable for any service interruptions due to server outages, maintenance, or other technical issues.

7. Limitation of Liability
To the fullest extent permitted by law, BenGMusic shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Service, including lost data or service outages.

8. Governing Law
These Terms are governed by the laws of the State of Connecticut, United States, without regard to conflict of law principles.

9. Changes to Terms
We may update these Terms occasionally. Any changes will be posted on our website and take effect immediately. Continued use of the Service after changes indicates acceptance of the updated Terms.

11. Copyright Infringement & Takedown Policy
BenGMusic respects the intellectual property rights of others. If you are a copyright owner or authorized representative and believe that content on BenGMusic infringes your rights, you may submit a takedown request by emailing help@bengmusic.com with the following information:

  • Your name and contact information

  • A description of the copyrighted work you believe has been infringed

  • The specific location of the content (e.g., playlist name, song title)

  • A statement that you have a good faith belief the content is not authorized

  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act

We will promptly review all requests and, if appropriate, remove the content.
